By accessing or using Flocus ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Flocus is a flow state tracking application that uses EEG data from compatible Muse headband devices to provide real-time focus metrics and session analytics. The Service is provided as-is and requires compatible hardware (Muse headband) and software (supported web browser or desktop application).

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription and Payments

Flocus offers both free and paid subscription tiers:

  • Free tier: One 30-minute session per day
  • Pro tier: Unlimited sessions and duration

Pro subscriptions are billed annually. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

5. Cancellation and Refunds

You may cancel your Pro subscription at any time through your account settings. Upon cancellation:

  • Your Pro access continues until the end of the current billing period
  • No refunds for partial billing periods (except under our 30-day guarantee)
  • Your account reverts to the free tier after the billing period ends
  • Your session data is retained unless you request deletion

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers
  • Share your account credentials with others
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization

7. Health Disclaimer

Flocus is not a medical device. The Service is intended for personal productivity and wellness purposes only. It is not designed to diagnose, treat, cure, or prevent any medical condition.

The flow scores and metrics provided are derived from consumer-grade EEG data and should not be used as a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your mental health or cognitive function, consult a qualified healthcare provider.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Flocus and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

9. Third-Party Hardware

Flocus requires a Muse headband manufactured by Interaxon Inc. We are not affiliated with, endorsed by, or sponsored by Interaxon. Any issues with your Muse hardware should be directed to Interaxon's support. We are not responsible for hardware malfunctions, compatibility issues, or data accuracy related to third-party devices.

10. Limitation of Liability

To the maximum extent permitted by law, Flocus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruption or inability to use the Service
  • Any conduct or content of third parties
  • Unauthorized access to or alteration of your data

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected. Use of the Service is at your own risk.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
